2. Description of Service

PostSurge is a Shopify app that enables merchants to display post-purchase upsell offers to customers after checkout. The service includes smart offer generation, A/B testing, analytics, and billing management through Shopify.

3. Account and Billing

PostSurge offers the following plans, billed through Shopify:

• Free — $0/month, 50 orders/month, 3% revenue fee on accepted upsells
• Growth — $14.99/month, 200 orders/month, 1% revenue fee
• Pro — $29.99/month, 1,000 orders/month, 0.5% revenue fee
• Scale — $49.99/month, unlimited orders, no revenue fee

Revenue fees apply only to the value of accepted upsell orders, not your total store revenue. All billing is handled by Shopify and subject to Shopify's billing terms.

4. Acceptable Use

You agree not to:

• Use PostSurge for any unlawful purpose or in violation of Shopify's terms
• Attempt to reverse engineer, copy, or create derivative works of the app
• Use the service in a way that disrupts or damages the platform
• Misrepresent your store or products to customers

5. Disclaimer of Warranties

PostSurge is provided "as is" without warranties of any kind. We do not guarantee specific revenue increases or conversion rates. Results vary based on your store, products, and customer base. We are not responsible for any lost revenue resulting from offer display issues or service interruptions.

6. Limitation of Liability

To the maximum extent permitted by law, PostSurge shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability shall not exceed the amounts paid by you in the 30 days preceding the claim.

7. Termination

You may cancel your subscription and uninstall PostSurge at any time. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your data will be retained for 90 days then permanently deleted.

8. Changes to Terms

We may update these terms from time to time. Continued use of PostSurge after changes constitutes acceptance of the updated terms. We will notify you of material changes via email.
